TERMS OF PURCHASE

These Terms of Purchase (“Terms”) govern your purchase of products and services available via herlixa.com/ (the “Company Pages” or the “Pages”). The Company Pages are operated by herlixa.com (the “Company”). Your use of the Company Pages and these Terms are also governed by the Terms of Use and Privacy Policy, which are incorporated herein by reference.

PLEASE READ THESE TERMS OF PURCHASE, ALONG WITH THE TERMS OF USE, PRIVACY POLICY, AND ANY OTHER POLICIES OR AGREEMENTS REFERENCED HEREIN, CAREFULLY BEFORE PURCHASING OR USING PRODUCTS OR SERVICES THROUGH THE COMPANY PAGES. BY PURCHASING OR USING PRODUCTS OR SERVICES THROUGH THE COMPANY PAGES, YOU AGREE TO THESE TERMS, INCLUDING, BUT NOT LIMITED TO, THE ARBITRATION AGREEMENT AND CLASS ACTION WAIVER DESCRIBED IN THE “DISPUTE RESOLUTION” SECTION.

GENERAL

These Terms constitute a valid and binding agreement between you and the Company. You represent and warrant that you: (1) are at least 18 years of age, (2) are legally competent to enter into a binding contract, and (3) are not prohibited from receiving services under applicable laws, rules, or regulations.

You must acquire and use the products and services available on the Company Pages in strict accordance with these Terms and all applicable laws, rules, and regulations (collectively, “Laws”). You are responsible for compliance with all applicable Laws regarding your purchase, including the Laws of the jurisdiction to which products are shipped. All calls, emails, and other communications between you and the Company may be recorded.

You agree that any personal information we may collect about you (via the Company Pages, email, telephone, or otherwise) will be collected, stored, and otherwise processed in accordance with the Privacy Policy. All changes will be posted on herlixa.com, and your continued use of the Pages after such changes constitutes acceptance of the updated Privacy Policy.

PURCHASES

Order Processing

The Company may, at its discretion, refuse to process or cancel your order. This may occur if the product or service you wish to purchase is out of stock, incorrectly priced, suspected to be fraudulent, or under other circumstances deemed appropriate by the Company. The Company may also take steps to verify your identity prior to processing your order. In such cases, no charges will be applied, or any charges will be refunded. Without limiting the foregoing, the Company reserves the right to: (i) withdraw any stated offer; (ii) correct errors, inaccuracies, or omissions; and (iii) modify prices, content, promotional offers, product descriptions, specifications, or other information without obligation to notify you (including after order submission, confirmation, shipping, or receipt, except as legally prohibited).

Product and Service Descriptions

The Company strives to provide accurate descriptions of products and services on the Company Pages. However, the Company does not guarantee that descriptions are complete, reliable, current, or error-free. If a product or service purchased on the Company Pages is not as described, your sole remedy is to return the item in accordance with these Terms.

The Pages may offer a Quick View feature for various products, allowing you to view pricing information and add items to your basket without opening the product page. This feature is provided for convenience only. Full product information—including origin, features, and pricing—is available on the product page.

Pricing Information

The Company makes reasonable efforts to provide accurate pricing information for products and services on the Company Pages, but cannot guarantee against pricing errors. The Company reserves the right to refuse or cancel orders for products or services listed at an incorrect price due to an error. In such cases, the Company will notify you via email. The Company also reserves the right to correct any error in the stated retail price at its discretion.

Product and Service Availability

The Company Pages may include information about product availability to estimate whether an item can be shipped immediately after your order. Estimated delivery to your UK address is approximately 30 days or less after successful payment. Availability may vary due to stock shortages, weather, courier transit time, and other factors. The Company cannot guarantee that an item listed as “in stock” will ship immediately. In rare cases, a product or service may be available when an order is placed but out of stock when the Company attempts to process it. In such instances, the Company will notify you via email and remove the item from your order.

Specific Additional Disclaimers and Obligations

In addition to general disclaimers in the Terms of Use for products and services purchased via the website:

  • (a) products and services purchased on the website may not include manufacturer warranties, even if available elsewhere;

  • (b) may not include service or support options;

  • (c) may not include product manuals, instructions, or safety notices in UK English or other target languages;

  • (d) may not comply with standards, specifications, or labelling requirements of your jurisdiction; and

  • (e) may not comply with UK electrical standards, requiring adapters or converters.

You are responsible for researching the product to ensure it meets your requirements and may be legally imported into your jurisdiction.

Taxes

You are responsible for all taxes, duties, and fees imposed by the jurisdiction to which products are shipped, including but not limited to UK VAT, sales taxes, and customs duties.
